Please read these Terms of Service carefully before using LandSleuth.com. These Terms govern your access to and use of the Platform operated by Land Sleuth, LLC, a Florida limited liability company. By using the Platform, you agree to these Terms in full.
By accessing or using LandSleuth.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing the Platform. These Terms constitute a legally binding agreement between you and Land Sleuth, LLC, a Florida limited liability company ("Company," "we," "us," or "our").
LandSleuth.com provides a subscription-based online platform that aggregates, organizes, and presents farmland sales transaction data sourced from public courthouse records and user submissions ("Service"). The Service is intended for use by licensed appraisers, agricultural lenders, farm managers, real estate professionals, and other agricultural industry participants. The Company does not provide real estate brokerage services, appraisal services, legal advice, or investment advice.
To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at [email protected] of any unauthorized use of your account. The Company reserves the right to terminate accounts that violate these Terms or that have been inactive for an extended period.
Access to the Platform's full data features requires a paid subscription. Subscription plans, pricing, and features are described on the Pricing page of the Platform and are subject to change with reasonable notice. Subscriptions are billed on a monthly or annual basis as selected at the time of purchase. All fees are non-refundable except as expressly stated in these Terms or as required by applicable law. You authorize the Company to charge your designated payment method for all applicable subscription fees. Failure to pay may result in suspension or termination of your account.
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to the Platform through that date. The Company does not provide prorated refunds for partial subscription periods except where required by applicable law. Annual subscriptions cancelled within 7 days of the initial purchase date may be eligible for a full refund at the Company's discretion.
The Company makes reasonable efforts to ensure the accuracy of farmland sales data presented on the Platform. Data is sourced from public courthouse records and user submissions. However, the Company does not warrant that all data is complete, accurate, current, or free from errors. Farmland sales data should not be used as the sole basis for any appraisal, lending decision, purchase, or sale without independent verification. THE PLATFORM AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
All content on the Platform, including but not limited to the database compilation, software, design, text, graphics, and logos, is the property of Land Sleuth, LLC or its content suppliers and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your own professional purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Platform without the express written consent of the Company.
Users who submit farmland sales data through the Platform's submission portal represent and warrant that such data is accurate to the best of their knowledge, that they have the right to submit such data, and that the submission does not violate any applicable law or third-party rights. By submitting data, you grant the Company a perpetual, worldwide, royalty-free license to use, reproduce, modify, and display such data as part of the Platform. The Company reserves the right to review, edit, or reject any submitted data.
You agree not to: (a) use the Platform for any unlawful purpose; (b) scrape, harvest, or systematically download data from the Platform by automated means; (c) resell or redistribute Platform data to third parties without written authorization; (d) attempt to gain unauthorized access to any portion of the Platform; (e) use the Platform to transmit any malicious code or harmful content; (f) impersonate any person or entity; or (g) interfere with the proper functioning of the Platform.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LAND SLEUTH, LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE COMPANY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Platform shall be resolved exclusively in the state or federal courts located in Brevard County, Florida. You hereby consent to the personal jurisdiction of such courts. The prevailing party in any such dispute shall be entitled to recover reasonable attorneys' fees and costs.
The Company reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the effective date below. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue your use of the Platform.
